How we use your data
PRELIMINARY.
Every employee, candidate and user of the platforms made available by Dexian, must read, analyze and, in case of free and spontaneous agreement, formalize their acceptance of the privacy policies stipulated in these terms.
The conditions for capturing, using, processing and deleting data are also established in this term.
1. METHOD OF DATA COLLECTION
1.1. All technologies used by Dexian comply with current legal and regulatory obligations, the Terms of Use and the terms of this Privacy Policy.
1.1.1. The user authorizes Dexian to maintain and store all information submitted to the platform, as well as all personal, registration and access data, such as: email addresses, IP addresses, data information and access times, generation of invoices, transactions, credits, other information.
1.2. Data is collected by the following modes; when the USER voluntarily enters data when accessing a platform; when interacting automatically with the features available therein; collection from third parties, including, but not limited to, identity verification services, credit protection services and public information sources; through service channels; session cookies. Collection includes:

1.2. Dexian is not responsible for the accuracy, veracity, failure or outdatedness of the information that the USER enters in their registration, when it is their responsibility to provide them accurately or update them.
1.3. The consent that the USER offers for the purposes of using the data is collected in an individual, clear, specific and legitimate manner.
1.4. Through the service channel, the USER can change their consent for the processing of their data, grant new necessary ones or withdraw their consent to the current conditions, being warned of the consequences that a withdrawal of consent may cause.
1.5. The collected data and resulting activities can also be shared:
a) With competent judicial, administrative or administrative authorities, whenever there is a legal determination, request, requisition or court order; enforce T&C; respond to 3 allegations of alleged violation of third party rights and to protect the rights, property or safety of third parties, Dexian itself and/or other USERS.
b) Exercise the right to defense in judicial, administrative or arbitration proceedings;

1.6. The database formed through data collection on the platform is the property and responsibility of Dexian, and its use, access and sharing will be done within the limits and purposes of the business and in this Privacy Policy.
1.6.1. Personally identifiable information is not disclosed, sold or shared by Dexian.
1.6.2. The USER is co-responsible for the confidentiality of their data. Sharing passwords and access data violates this Privacy Policy, the Employee Manual and the Dexian Confidentiality Agreement.
1.7. Internally, the collected data is accessed only by duly authorized professionals, in a segregated manner, respecting the principles of proportionality, necessary and generated for the development of Dexian’ activities, in addition to the commitment to confidentiality and preservation of privacy under the terms of this Privacy.
1.8. For the purposes of this privacy policy, a definition of Cookies is: small text files transferred via a server to a hard drive stored on the computer that may collect information such as data and access time, browsing history, payee and user name.
2. PURPOSE OF COLLECTION
Personal data is used in accordance with the local purposes below, with their legal bases, which authorize their processing:

3. HOW WE STORE DATA AND RECORDS
3.1. The data collected and records of activities stored in an environment controlled by Dexian will be controlled and stored for as long as the legal relationship between the parties continues, up to a period of 5 (five) years after the end of the legal relationship between the parties.
3.2. If requested by the USER, the data will be anonymized before this deadline, or may be discarded, using secure disposal methods, or used in an anonymized form for statistical purposes.
3.3. The collected data and information regarding candidates and employees are kept in a database chosen by Dexian and which meets the high security standards required.
3.3.1 Dexian reserves the right to retain information for the legal period for the proper fulfillment of its business, as well as to meet legal, regulatory and/or normative purposes, even after the end of the legal relationship.
3.4. It is necessary for Dexian to transmit data to other companies that are part of the economic group it is part of, or to an external service provider, which may also be based outside brasil, but which acts exclusively on behalf of Dexian.
3.5. For T&C purposes, a definition of Cookies is: small text files transferred via server to the hard drive and stored on the computer that can collect information such as data and access time, browsing history, payee and user name.
3.6. The USER has the option to accept or refuse the use of cookies on their computer, regardless of registration on the website, by configuring their browser as desired. 4. DATA SUBJECT’S RIGHTS
4.1. The Data Subject has the right to:
Access. Request and receive a copy of personal data stored by Dexian. Request clarification on how Dexian captures personal data, what is the regularization of processing and with whom the data is shared.
Rectification. Rectification of personal data that is incomplete, inaccurate or outdated, through verification of validity and veracity by Dexian.
Anonymization, blocking, deletion. Request anonymization, blocking or deletion of personal data that the holder entity is considered in a manner contrary to this Policy or in non-compliance with applicable data protection legislation.
Distinction. Opposition to data processing that is not carried out based on consent. In these cases, Dexian can demonstrate that it has the legitimacy to process the data in accordance with this Policy, to provide the services accordingly.
Exclusion. Request deletion of personal data stored by Dexian, processed through consent, that is no longer given or relevant to the provision of services, provided that there is no other reason to provide it, such as to comply with a legal or regulatory obligation to retain the data or to protect the rights of Dexian.
Non-consent. Refusal to the processing of personal data based on your consent at any time. However, withdrawal of consent may result in the impossibility of providing services.
Revision. Request a review of decisions made solely based on automated processing, if the holder understands that they are affecting their interests.
Portability. Right to request data portability in a structured and interoperable format.
4.2. If the USER withdraws their consent for purposes that are fundamental to the regular functioning of Dexian, the services and functionalities may become unavailable.
4.2.1. If the USER does not grant consent for optional purposes related to sending communications, content, news and other events relevant to maintaining the relationship, Dexian services and functionalities will continue to be made available regularly.
4.3. For the purposes of auditing, security, fraud control and preservation of rights, Dexian may retain the USER’s data recording history for a longer period of time in the cases that the law or regulatory standard so establishes or to preserve rights.
5. GENERAL PROVISIONS
5.1. Dexian does not use any type of automated decision that impacts the USER.
5.2. Dexian has the right to change the content of this Privacy Policy at any time, according to need or need, such as for adequacy and legal compliance with a provision of law or standard that has equivalent legal force, and the USER is responsible for checking it whenever access the Dexian Connect and Vacancy Board platforms on the Dexian website.

The USER acknowledges that all communication carried out by email (to the addresses provided in their registration), SMS, instant communication applications or any other virtual and digital form are also valid, effective and sufficient for the dissemination of any matter that refers to legal relationship, services provided by Dexian, as well as the conditions of their provision or any other matter addressed therein, except as provisions expressly defined in this Privacy Policy.

6.1. Dexian customer service channels are available to the USER, via email and telephone. Dexian responses always occur on working days, from 9am to 6pm.

7. APPLICABLE LAW AND JURISDICTION
7.1. This Privacy Policy will be governed and interpreted in accordance with brasilian legislation, in the Portuguese language, with the Court of the District of Dexian’ headquarters being elected to resolve any dispute or controversy involving this document, unless specific exceptions regarding personal, territorial or functional competence by the applicable legislation.
